Welcome to Fetchaa. Fetchaa Inc. and/or its affiliates ("Fetchaa", "we", "us", or "our") provide website features and other products and services to you when you visit or shop at Fetchaa, use our mobile applications, or use software provided by Fetchaa in connection with any of the foregoing (collectively, "Fetchaa Services"). By using the Fetchaa Services, you agree, on behalf of yourself and all members of your household and others who use any Fetchaa Service under your account, to the following conditions.
We offer a range of Fetchaa Services that may be subject to additional terms. When you use a particular Fetchaa Service, you also will be subject to the terms applicable to that service. If these Terms of Use are inconsistent with those additional terms, the additional terms will control.
OVERVIEW OF OUR SERVICES
Fetchaa is a cross-border shopping and logistics service. We source products from global retailers and deliver them to you through our "pay once, receive locally" model. When you place an order, the price you see at checkout is the total landed cost — it includes the product price, shipping, import duties, taxes, insurance, and our service margin. There are no hidden fees, customs surprises, or additional charges at collection.
Your order is purchased by Fetchaa on your behalf, shipped to our consolidation hub, cleared through customs, and delivered to the Fetchaa collection point in Harare or to the delivery address you provided.
YOUR ACCOUNT
You may need an account to use certain Fetchaa Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information when you register, and to keep that information up to date.
Accounts are for personal, non-commercial use by a single user. You may not share your account credentials with others or allow another person to use your account. We may suspend or terminate your account if we reasonably believe you have violated these Terms.
PRICING AND PAYMENT
All prices displayed on Fetchaa are in United States dollars (USD) unless otherwise stated. The total you pay at checkout is the guaranteed landed cost for your order, calculated at the time of purchase and comprising:
- the product price,
- shipping and handling,
- applicable import duties and taxes,
- loss and damage insurance, and
- Fetchaa's service margin, which includes an FX buffer that protects your order against currency fluctuations between the time you pay and the time your order is procured.
Payment is processed securely through our third-party payment provider (Stripe). By placing an order, you authorize us to charge the payment method you provided. If your payment is declined or fails, your order may be cancelled. We may update prices at any time, but the price confirmed at checkout is the price you pay for that order.
ORDERS AND FULFILLMENT
When you place an order, you will receive an order confirmation with a unique suite number that identifies your package through every stage of its journey. Orders progress through the following stages: payment confirmed, purchased, in transit, in customs, ready for collection, and delivered.
Once your items arrive at the Fetchaa collection point in Harare, we will notify you by email, SMS, or WhatsApp. You will need to present a valid form of identification to collect your package. If you chose courier delivery, your package will be delivered to the address you provided at checkout.
Delivery estimates are provided in good faith but are not guaranteed. Delays can occur due to customs inspections, flight schedules, or events outside our control. We will keep you informed of any significant delays.
ELECTRONIC COMMUNICATIONS
When you use Fetchaa Services, or send emails, text messages, and other communications from your desktop or mobile device to us, you may be communicating with us electronically. You consent to receive communications from us electronically, such as emails, text messages, push notifications, or notices on this site, and you can retain copies of these communications for your records. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
RETURNS, REFUNDS, AND CANCELLATIONS
You may cancel an order for a full refund at any time before we have purchased the items on your behalf. After that point, orders are subject to our Return Policy. If an item arrives damaged, is lost in transit, or is incorrect, we will refund or replace it in accordance with our Return Policy. Certain items — including perishable goods, items that cannot be resold for health or hygiene reasons, and items that have been used or altered — may not be eligible for return.
INTELLECTUAL PROPERTY
All content included in or made available through any Fetchaa Service, such as text, graphics, logos, button icons, images, digital downloads, and software, is the property of Fetchaa or its content suppliers and is protected by copyright and other intellectual property laws. The compilation of all content included in or made available through any Fetchaa Service is the exclusive property of Fetchaa and protected by applicable law.
Fetchaa's trademarks and trade dress may not be used in connection with any product or service that is not Fetchaa's, or in any manner that is likely to cause confusion among customers. Trademarks not owned by Fetchaa that appear in any Fetchaa Service are the property of their respective owners.
LICENSE AND ACCESS
Subject to your compliance with these Terms, Fetchaa grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal, non-commercial use of the Fetchaa Services. This license does not include any resale or commercial use of any Fetchaa Service or its contents; any collection and use of product listings, descriptions, or prices; any derivative use of any Fetchaa Service or its contents; or any use of data mining, robots, or similar data-gathering and extraction tools.
You may not misuse the Fetchaa Services, interfere with their operation, attempt to gain unauthorized access to any part of them, or use them for any unlawful purpose. We may terminate your access to the Fetchaa Services at any time if you violate these Terms.
DISCLAIMERS AND LIMITATION OF LIABILITY
The Fetchaa Services and all information, content, and materials included in or made available through them are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Fetchaa disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose.
Products sold through Fetchaa are sourced from third-party retailers and manufacturers, and are not manufactured by Fetchaa. Fetchaa is not liable for any defects in, or the performance of, any product sourced through our Services beyond the terms of our Return Policy.
To the fullest extent permitted by law, Fetchaa, its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, arising out of or in connection with your use of the Fetchaa Services, even if advised of the possibility of such damages. Our total liability to you arising out of or in connection with the Fetchaa Services will not exceed the total amount you paid for the order giving rise to the claim.
DISPUTES AND GOVERNING LAW
These Terms are governed by the laws of the United States of America, without regard to conflict of law principles, except where local law in your jurisdiction requires otherwise. You agree that any dispute arising out of or relating to these Terms or the Fetchaa Services will be resolved in the courts of the United States of America, except where mandatory law in your jurisdiction provides otherwise. Nothing in these Terms affects any statutory rights you may have as a consumer.
CHANGES TO THESE TERMS
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, where appropriate, notify you by email or by a notice on this site. Your continued use of the Fetchaa Services after any changes become effective constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you should stop using the Fetchaa Services.
